§ 136.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   (1)   Each day a violation of § 136.01 through 136.06 exists shall be considered a separate offense.
      (2)   The City Attorney may institute any action for injunctive relief to enforce the provision of this § 136.01 through 136.06.
      (3)   Every act or omission constituting a violation of any of the provisions of § 136.01 through 136.06 by any agent or employee of any person shall be deemed and held to be the act of such person, and said person shall be punishable in the same manner as if said act or omission had been done or omitted by him, her or it personally, provided such act or omission was with the scope of employment or the scope of authority of such agent or employee.
      (4)   Any person who shall violate or fail to comply with any of the provisions of § 136.01 through 136.06 shall be subject to penalty as provided in § 130.99 of this code.

   (C)   (1)   Any person who violates § 136.22(A) is guilty of an ordinance violation and upon conviction may be fined not more than $750 nor less than $75.
      (2)   Any person who violates § 136.22(B) is guilty of an ordinance violation and upon conviction may be fined not more than $750 nor less than $75.
      (3)   Any person who violates § 136.22(C) is guilty of special offense and upon conviction may be fined not more than $750 nor less than $75.
   (D)   For violation of § 136.35, a police officer may issue to the violator a citation:
      (1)   Ten grams or less: a fine of not more than $200 or less than $100; and
      (2)   Cannabis drug paraphernalia: a fine of not more than $200 or less than $100.

   (E)   (1)   Any person who violates § 136.52(A) is guilty of an ordinance violation and upon conviction may be fined not more than $750 nor less than $25.
      (2)   Any person who violates § 136.52(B) is guilty of an ordinance violation and upon conviction may be fined not more than $750 nor less than $25.
      (3)    Any person who violates § 136.52(C) is guilty of a special offense and upon conviction may be fined not more than $750 nor less than $25.
