§ 112.03 PUBLIC POSSESSION OR CONSUMPTION OF ALCOHOL.
   (A)   Generally. No person, firm, or corporation, partnership, association, corporation, company, or organization of any kind shall drink or consume any alcoholic liquor on the sidewalks or streets within the city limits. It shall be further prohibited to consume or possess on the streets or sidewalks an open bottle or container of alcoholic liquor unless authorized by a special permit issued by the City Liquor Commissioner. Said permit allowing consumption and possession of alcoholic beverages on public streets and sidewalks may only be issued in the event of a residential street/block party which has received prior approval from the City Council.
   (B)   Outside consumption of alcohol without a license. Establishments which have a liquor license but do not hold an outside license may receive a written permit from the Liquor Commissioner to allow the outside consumption of alcohol. Said permit shall only be obtained by making written application at least 24 hours in advance and specifying the time for which the permit is requested and the reasons therefor.
   (C)   Consumption in parks. No person shall consume alcoholic liquor in any park owned by the city unless authorized by the Liquor Commissioner. Said authorization shall only be obtained by making application at least 24 hours in advance and submitting information as to the name, address, and telephone number of the person, group of persons, firm, partnership, corporation, or association or organization requesting the permit. Such a permit shall only be issued to a resident of the city. The provisions of this division (C) shall not apply to Belk Park. A cash bond in the amount of $100 shall be posted with the city as a guarantee against destruction, litter, or other damage to city-owned property. If, in the opinion of the City Manager, no damage or litter has taken place, the deposit shall be refunded. A permit, if issued, shall be good for one day unless renewed.
