§ 50.15 CARTS/CONTAINERS.
   (A)   Garbage and rubbish shall be placed in one contractor container of either a 95 gallon or 65 gallon cart. Both garbage collection and recycle collection are curbside collections. Both garbage and recycle collections are limited to cart contents only; therefore, bags/items lying outside of carts will not be serviced.
   (B)   Business establishments and multi-family residential complexes which have garbage and rubbish sufficient to make impractical its storage in the contractor container, the property owner shall be responsible for providing other suitable means of containing the garbage and rubbish between the regularly schedule collection. No garbage shall be placed in any container unless if it is fly-tight construction. Containers shall be situated in such a manner as to be readily accessible to collection crews.
   (C)   Carts/containers should be cleaned as necessary as to not become a nuisance.
   (D)   It shall be unlawful for any person to molest, remove, handle, or otherwise disturb the containers or contents which have been placed on the city property for serving by the collectors. Provided that this section does not apply to the owner, occupant, lessee, or tenant of the residence or dwelling so placing the container and contents.
   (E)   (1)   Multi-family residential complexes consisting of more than three residential units shall have a container furnished, for the joint use of all occupants of the complex, by the property owner, unless specifically authorized by the city. The container shall be of sufficient size to be capable of storing the garbage and rubbish of the occupants for the time period between scheduled collections.
      (2)   The container must be approved by the Director of Public Services and, if after the container is approved and proves incapable of properly containing the garbage and rubbish, another container shall be provided that is either capable of containing the garbage and rubbish or additional containers shall be provided so as to properly contain the garbage and rubbish between the scheduled collections.
