It shall be unlawful: (1976 Code §8-13; amd. Ord. 90-40, 6-14-1990)
A. Reserved. (Ord. 2011-45, 9-8-2011)
B. Burying Refuse: To bury refuse, landscape waste and/or recyclable material at any time within the village limits. (1976 Code §8-14; amd. Ord. 90-40, 6-14-1990)
C. Storage Creating A Fire Hazard: To permit the storage of or to store any refuse, landscape waste and/or recyclable material in any such way as to create a fire hazard. (1976 Code §8-15; amd. Ord. 90-40, 6-14-1990)
D. Unsanitary Deposits 1 : For any person to place, deposit or permit to be deposited in an unsanitary manner upon any public or private property within the village, the carcass of any animal or any offal, filth or noisome substance. (1976 Code §8-16)
E. Unauthorized Dumping: For any person to dump, deposit or place any refuse, landscape waste and/or recyclable material upon real property owned by another without the consent of the owner or person in possession of such real property, and otherwise in conformance with all applicable regulations set forth in this chapter. (1976 Code §8-17; amd. Ord. 90-40, 6-14-1990)
F. Dumping Into Bodies Of Water, Sewers, Streets 2 : To dump or deposit refuse, landscape waste and/or recyclable material, construction waste, the carcass of any dead animal or any offal, filth or noisome substance or any other offensive matter in any watercourse, lake, pond, spring, well or common sewer, street or public highway. G. Sweeping Into Streets: For any person to sweep or deposit any sweeping from any sidewalk, driveway, building or any construction activity onto any public or private street, alley or parkway. (1976 Code §8-19)
H. Certain Other Offenses: For any person, other than the owner to:
1. Obtain or exert unauthorized control over a village landscape waste tag, recycling container or refuse tag; or
2. Obtain, by deception, control over a village landscape waste tag, recycling container or refuse tag; or
3. Obtain, by threat, control over a village landscape waste tag, recycling container or refuse tag; or
4. Obtain control of a stolen village landscape waste tag, recycling container or refuse tag knowing any of such to have been stolen or under such circumstances as would reasonably induce such person to believe that any of such property was stolen; and, when such person:
a. Intends to deprive the owner permanently of the use or benefit of any of such property; or
b. Knowingly uses, conceals or abandons the property in such a manner as to deprive the owner permanently of such use or benefit; or
c. Uses, conceals or abandons the property knowing such use, concealment or abandonment probably will deprive the owner permanently of such use or benefit. (Ord. 92-15, 4-23-1992)
