A. Adoption: The customer service and privacy protection law, 220 Illinois Compiled Statutes 5/70-501, and all regulations promulgated thereunder, are hereby adopted by reference and made applicable to cable and video providers offering services within the village.
B. Amendments: Any amendment to the cable and video customer protection law or regulations promulgated thereunder that become effective after the effective date hereof shall be incorporated herein by reference and shall be applicable to cable or video providers offering services within the village. Notwithstanding the foregoing, any amendment that makes its provisions optional for adoption by municipalities shall not be incorporated herein without formal action by the village board. A. Enforcement: The village hereby declares its intent to enforce all customer service and privacy protection standards set forth in the cable and video customer protection law with respect to complaints received from residents of the village. It is the village's intent to impose such penalties as are permitted by law to ensure the privacy of village residents and the provision of high quality cable and video services thereto.
For the purposes of this section, the term "material breach" means any substantial failure of a cable or video provider to comply with service quality and other standards specified in any provision of the law.
B. Penalties: Pursuant to section 70-501(r)(1) of the cable and video customer protection law, 220 Illinois Compiled Statutes 5/70-501(r)(1), the village hereby provides for a schedule of penalties for any material breach of the cable and video customer protection law by cable or video providers, in addition to such other and further penalties provided by law. The monetary penalties imposed herein shall apply on a competitively neutral basis and shall not exceed seven hundred fifty dollars ($750.00) for each day of the material breach, and shall not exceed twenty five thousand dollars ($25,000.00) for each occurrence of a material breach per customer. Each day that a material breach remains outstanding after the cable or video service provider has received notice thereof, shall constitute a separate and distinct violation of this chapter.
