3-7-1: DEFINITIONS:
Whenever the following terms are used in this Chapter, they shall have the meanings respectively ascribed to them as follows:
BUS: Every motor vehicle, other than a commuter van, designed for carrying more than ten (10) passengers and used for the transportation of persons, and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation.
COMMUTER VAN: A motor vehicle designed for the transportation of not less than twelve (12) nor more than sixteen (16) passengers when such transportation is incidental to another purpose of the driver who is not engaged in the transportation of persons as a business, and providing further that such motor vehicle is owned, leased for or by a company or an employee organization and operated on a nonprofit basis with the primary purpose of transporting employees of the company between the employees' homes and the company's place of business or a public transportation station and in which the operating, administrative, maintenance and reasonable depreciation costs are paid principally by the persons utilizing the commuter van.
PERSON: Any individual, firm, partnership or corporation.
SCHOOL BUS: Every motor vehicle, except as provided in the following paragraph, owned or operated by or for any of the following entities for the transportation of persons regularly enrolled in any such entity as students in grade twelve (12) or below in connection with any activity of the entity. A school operated by a religious institution or a public or private nursery, primary or secondary school.
This definition does not include the following:
   A.   A bus operated by a public utility, Municipal corporation or common carrier authorized to conduct local or interurban transportation of persons when the bus is on a regularly scheduled route for the transportation of other fare-paying persons or furnishing charter service for the transportation of groups on field trips or other special trips, or in connection with special events or for shuttle service between attendance centers or other educational facilities and not over a regular or customary scheduled school bus route;
   B.   A motor vehicle of the first division as defined by 625 Illinois Compiled Statutes, 5/1-171.01.
TRANSPORTATION OF PERSONS: Any service in connection with the receipt, carriage and delivery of the person transported and his baggage, and all facilities used or necessary to be used in connection with the safety, comfort and convenience of the person transported. (1976 Code §6-1)
3-7-2: LICENSE REQUIRED; EXCEPTIONS:
It shall be unlawful to engage in the business of operating a scheduled bus service for the transportation of persons within the corporate limits of the Village without first having secured a license therefor.
Notwithstanding any language contained in this Section to the contrary, no license shall be required for the following:
   A.   The business of operating a scheduled school bus service within the corporate limits of the Village.
   B.   The business of operating a scheduled bus service for the transportation of persons within the corporate limits of the Village, where such bus service is otherwise being regulated by the Illinois Commerce Commission and/or the Interstate Commerce Commission. (1976 Code §6-2)
