(a) No person shall play any radio, music player or an audio system in a motor vehicle at such volume as to disturb the quiet, comfort or repose of other persons or at a volume which is plainly audible to persons other than the occupants of said vehicle.
(b) Whoever is convicted of or pleads guilty to a violation of this section, the following penalty applies for:
(1) | 1st Offense: | a mandatory fine of two hundred dollars ($200.00); |
(2) | 2nd Offense: | a mandatory fine of four hundred dollars ($400.00); |
(3) | 3rd Offense and Thereafter: | a mandatory fine of one thousand dollars ($1,000). |
