1313.08 BUFFER ZONES.
   (a)    No permits shall be issued by any official or board of the Village for the construction of new buildings or the modification or repair of existing structures located on property within an apartment use U-2 District or a commercial use U-3 District unless the property is separated from other property and dedicated streets by a buffer strip to be no less than ten feet in width, landscaped with trees or shrubs of no less than five feet in height, and planted in a manner to establish immediate screening.
   (b)    No permits shall be issued by an official or board of the Village for the construction of new buildings or the modification or repair of existing structures located on property within an apartment use U-2 District or a commercial use U-3 District unless the property has a five-foot wide buffer strip running parallel with the street from the right-of-way line into the property. This strip is to be planted with shrubs or flowers to a maximum height of two feet, six inches above the grade level.
   (c)    Whoever occupies any such property, whether under lease or any other arrangement shall be jointly liable with the owner for the care and maintenance of the buffer strip, which shall at all times be maintained in the condition approved by the Planning and Zoning Commission.
