§ 33.18 SEALED BIDDING PROCEDURES.
   (A)   The agency, department, official or person requiring a contract or purchase from county funds which exceeds an aggregate amount of $30,000 shall submit to the Fiscal Court a written request containing specifications, quantities and delivery desired.

   (B)   The Fiscal Court shall examine the request and approve or reject it. If the request is approved, the Fiscal Court shall set a maximum amount to be expended and any evaluation factors to be considered in bid selection.
   (C)   The agency, department, official or person requiring the contract or purchase shall submit to the Clerk of the Fiscal Court an appropriate advertisement for bid which the Clerk shall have placed in the newspaper of largest circulation in the county at least once, not less than 7 nor more than 21 days before bid opening. The advertisement shall include the time and place where the specs may be obtained, and that the Fiscal Court reserves the right to reject any and all bids.
   (D)   The Clerk of the Fiscal Court shall open bids in a public forum. In the event that the Fiscal Court adopts a uniform bid form which is required on a certain bid, failure to use and follow this bid form shall be a basis to reject any nonconforming bid. The Fiscal Court may reject all bids or may select the best bid as evaluated and determined by the Court. Consideration shall be given to the lowest bid, but cost alone shall not be the sole criteria to be utilized by the Fiscal Court when awarding a bid. If all other factors are equal, then the lowest bid shall be determined to be the best bid. The Clerk of the Fiscal Court shall notify all bidders of the award.
   (E)   The Judge/Executive shall sign a contract or issue a purchase order with the one receiving the award.
