For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
NUISANCE. Any condition or use of premises or building exteriors which is detrimental to the property of others, or which causes or tends to cause substantial diminution in the value of other adjoining or neighborhood property in which the premises are located, or which cause or tend to cause discomfort to other persons using or residing upon other adjoining or neighborhood property because of odors, fumes, noise, or any other noxious emission from all activity upon the premises upon which the detrimental condition or use is located; provided, however, those normal farming and agricultural practices and activities usually carried on in Woodford County shall not be included in this definition of NUISANCE.
RESIDENTIAL. Any area of Woodford County outside of the city limits of Versailles and Midway that is zoned residential, rural residential, or small community; or has an active Home Owners Association (HOA) with deed restrictions and covenants; or, involves lots 1 acre in size or less.
