(A) The provisions of this chapter shall apply to the purchase of conservation easements by the Woodford County Rural Land Board in partnership with an accredited land trust.
(B) In order for a conservation easement to be considered for purchase by the Woodford County Rural Land Board or a partner accredited land trust, it must meet the following minimum criteria;
(1) The applicant or applicants must have good, marketable, fee simple title to the parcel of land upon which the conservation easement is proposed to be imposed;
(2) The parcel of land upon which the Conservation Easement is proposed to be imposed must be located entirely inside the rural service area as determined by the Woodford County Fiscal Court’s most recently adopted comprehensive plan;
(3) The parcel of land in question must be at least 30 acres in size unless contiguous to a parcel of land that is already in a conservation easement with the Woodford County Rural Land Board or any other land conservation organization, in which case an application may be submitted to the Board for review.
(C) It shall not be necessary for an application to cover all land in common ownership in order to be considered for purchase of a conservation easement. Accordingly, a landowner may submit an application for only a portion of the applicant’s land, if there is enough land to create a conservation easement of at least 30 acres.
(D) The WRLB may decide to assist another accredited land trust with applications for purposes of protecting Woodford County land with conservation easements rather than submitting the application.
