(A) The provisions of this chapter shall apply to donations of conservation easements.
(B) In order for a conservation easement to be considered for donation by the Woodford County Rural Land Board, it must meet the following minimum criteria:
(1) No other accredited land trust is willing to accept the conservation easement;
(2) The applicant or applicants must have good, marketable, fee simple title to the parcel of land upon which the conservation easement is proposed to be imposed;
(3) The parcel of land upon which the conservation easement is proposed to be imposed must be located entirely outside of the urban service boundary as determined by the Woodford County Fiscal Court’s most recently adopted comprehensive plan;
(4) The parcel of land upon which the conservation easement is proposed to be conveyed to the Woodford County Rural Land Board is free and clear of any non-conforming uses; and
(5) The parcel of land in question must be at least 30 acres in size unless contiguous to a parcel of land that is already in a conservation easement with the Woodford County Rural Land Board or any other land conservation organization, in which case an application may be submitted to the Board for review.
