§ 151.05 FISCAL COURT ACTION.
   (A)   Within 21 days after making the designation as provided for in § 151.04 above, the Clerk of the Fiscal Court shall present the request to the full Fiscal Court. To be effective, any designation application must be confirmed by the Fiscal Court. Any designation not brought to a vote of Fiscal Court within 90 days after application submission shall be deemed confirmed. The Fiscal Court shall notify the owner(s) of the affected property of the designation. Any aggrieved applicant shall have an appeal to Woodford Circuit Court of any final designation by Fiscal Court by filing an action therein within 30 days of the Fiscal Court vote on the matter. After submission of application, and pending Fiscal Court review and approval, no building, wrecking, grading or other permits shall be issued by any government agent or agency.
   (B)   Upon the confirmation of a designation as historic structure by Fiscal Court, the requesting landowner shall record notice of the designation with the Woodford County Clerk’s Office, at the landowner’s expense.
   (C)   The Fiscal Court, after application and prior to exercising its authority to designate buildings or structures as historic structures, shall first obtain the voluntary written consent of the owner of the building or structure, and only after advising the owner, in writing, of any advantages and disadvantages to the owner which are likely to result from the exercise of that authority, in a form and manner to be prescribed and approved by the Fiscal Court. Failure of the applicant to consent in this regard shall toll the 90-day period for Fiscal Court action by a period equal to the number of days it takes for the applicant to respond.
