The County Fiscal Court shall advertise and seek proposals to serve each franchise area. Applications for franchises shall be filed with the County Fiscal Court on forms approved by the County Fiscal Court. The County Fiscal Court may grant a franchise only upon finding that the applicant will render prompt, efficient and continuing service to the area for which the franchise is granted, and that the applicant has sufficient equipment and personnel to render service to all persons generating solid waste within the service area. A franchise shall be granted for a term of 3 years and may be renewable upon contract terms. No franchise shall be assignable.
