§ 36.083 GRIEVANCE PROCEDURE.
   (A)   From time to time, differences may arise between employees and employers. Every attempt should be made by both to resolve these differences on an informal basis. Employees and supervisors shall work together to resolve any grievance or dispute.
   (B)   Pending failure of resolution on an informal basis, any grievance or dispute, which may arise from employment with the county, shall be resolved in the following manner:
      (1)   Using the grievance initiation form, the employee shall present in writing the grievance and suggestions as to how the grievance may be resolved to his or her immediate supervisor within 7 calendar days of its occurrence. The supervisor or Department Head shall then attempt to adjust the matter and shall respond to the employee in writing within 7 days of the presentation. A sample form is referenced in § 36.085.
      (2)   If the grievance remains unadjusted, the employee may then present it in writing to the Judge/Executive within 7 calendar days after the response by the supervisor or the Department Head is due. The Judge/Executive should hear all parties concerned and shall attempt to resolve the grievance. The Judge/Executive shall respond in writing to the employee within 7 days of the meeting of the parties.
      (3)   If the grievance remains unresolved, the employee may make a written request, within 7 days after the response of the Judge/Executive is due, to meet with the Woodford County Fiscal Court to present the grievance on the day of the next scheduled court meeting. The Judge/Executive with the approval of the Fiscal Court shall respond in writing within 10 calendar days of the Fiscal Court meeting with the employee.
      (4)   The decision of the Judge/Executive with the approval of the Fiscal Court is final.
      (5)   A copy of all previous written documents involved in the action shall be attached to the grievance and made a part thereof.
      (6)   All employees are assured there will be no reprisal against any employee because he or she submitted a grievance. All employees should recognize that group grievances are impossible to handle in a reasonable way and therefore will not be accepted.
      (7)   In the event that a grievance is with a Department Head, he or she may present the written grievance to the Judge/Executive and proceed with division (B)(2) above and the following steps.
