§ 36.065 HOLIDAYS.
   Employee benefits are a basic ingredient in personnel administration. Benefits provided by Woodford County include the following:
   (A)   Holidays include the following 92 hours:
      (1)   New Year’s Day: 8 hours;
      (2)   Martin Luther King Day: 8 hours;
      (3)   Good Friday (½ day): 4 hours;
      (4)   Memorial Day: 8 hours;
      (5)   Independence Day: 8 hours;
      (6)   Labor Day: 8 hours;
      (7)   Veterans’ Day: 8 hours;
      (8)   Thanksgiving Day: 8 hours;
      (9)   Friday after Thanksgiving Day: 8 hours;
      (10)   Christmas Eve; 8 hours;
      (11)   Christmas Day: 8 hours; and
      (12)   New Year’s Eve: 8 hours.
   (B)   When a holiday falls on Saturday, the Courthouse should be closed on the preceding business day. When a holiday falls on Sunday, the Courthouse should be closed on the following business day. The Judge/Executive shall designate the days that the Courthouse will be closed if different than this policy. The county customarily adopts the same holidays as the state.
   (C)   In addition to the above, any day may be designated as a holiday by proclamation of the County Judge/Executive, with the approval of the Fiscal Court.
   (D)   Regular full-time employees who work on an 8-hour holiday shall be compensated for the hours worked on the holiday plus 8 hours at regular rate (extra pay for working on the holiday) or another day off (8 hours). Exception: On Good Friday, full-time employees who work on the holiday shall receive pay for the hours worked on the holiday plus 4 hours extra pay at regular rate. The full-time employees who do not work shall receive 4 hours at regular rate. Each department shall submit its policy on holidays to the Personnel Administrator. Holiday pay should be in the department budgets in order to pay extra pay for holidays instead of time off.
   (E)   Regular full-time employees who take time off for the holiday shall receive 8 hours at regular rate for all holidays except Good Friday, which shall be 4 hours at regular rate.
   (F)   Holiday hours may be accumulated up to a maximum of 96 hours.
   (G)   When a full-time employee resigns, he or she shall be paid for accumulated holiday time.
   (H)   Part-time employees shall receive pay for all hours worked on the holiday at time and one-half.
   (I)   Employees who are not at work the day before or the day after a holiday will not receive pay for the day(s). Exceptions to this policy may be granted when the absence is scheduled prior to the day before a holiday, for example: vacation, planned medical appointments and the like. If an employee takes an unscheduled day off work the workday immediately before and/or after the holiday, the employee is required to provide a statement from a physician to substantiate the use of benefit time. If no statement is provided, the employee will not be paid for the unscheduled day(s) off work regardless of whether benefit time is available to be used for the time. Effective date for this division (I) is January 12, 2005.
   (J)   Attendance. Attendance is a critical component of an employee’s success in the workplace. In the event an employee exhausts the balance of available sick, holiday and vacation hours and is off work without pay, they may be subject to disciplinary action up to and including termination of employment. (Exceptions to this include absences eligible for and covered by Family and Medical Leave Act and Medical Leave of Absence policies of the Woodford County Fiscal Court.)
