ORDINANCE NO. G-03-1135
AN ORDINANCE ADOPTING THE CODE OF ORDINANCES PUBLISHED BY AMERICAN LEGAL PUBLISHING CORPORATION, INCLUDING THE 2002 SUPPLEMENT THERETO, AS THE OFFICIAL CITY OF WOODBURN, INDIANA CODE OF ORDINANCES
   WHEREAS, the City of Woodburn, Indiana contracted with American Legal Publishing Corporation of Cincinnati, Ohio ("American Legal") in 1996 to codify and to publish the current and duly adopted Ordinances of the City of Woodburn ("the Code of Ordinances"), Indiana for inspection by the public pursuant to Indiana Code Section 36-1-5-3; and
   WHEREAS, since that time, American Legal has completed the following supplement:  2002 S-5 Supplement to the Code of Ordinances of the City of Woodburn, Indiana (hereinafter the "Supplement"); which Supplement contains all ordinances of a general and permanent nature; and
   WHEREAS, the Common Council of the City of Woodburn, Indiana has determined that the Code of Ordinances and the Supplement as published are a true restatement or reenactment of original ordinances, or amendments thereof, duly passed by the Common Council and signed by the Woodburn City Mayor; and
   WHEREAS, it is the intent of the Common Council of the City of Woodburn, Indiana to adopt the Code, including the Supplements, as the official Code of Ordinances for the City of Woodburn, Indiana; and
   WHEREAS, it is necessary the Code, including the Supplement, take effect immediately in order to provide for the usual daily operation of the municipality and for the immediate preservation of the public peace, health, safety and general welfare of the municipality;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF WOODBURN, INDIANA THAT:
   The Code of Ordinances Published by the American Legal Publishing Company of Ohio, including the 2002 S-5, supplement to the Code of Ordinances as submitted by American Legal is hereby incorporated by reference as if fully set forth herein;
   The Common Council of the City of Woodburn, Indiana has determined that the Code of Ordinances and the supplement thereto identified above, as published, are a true restatement or reenactment of original ordinances, or amendments thereof, duly passed by the Common Council and signed by the Woodburn City Mayor, and, as such, the Code and Supplements are hereby considered re-ordained under the authority of Indiana Code Section 36-1-5-6;
   The Code of Ordinances Published by the American Legal Publishing Company of Ohio, including the 2002 S-5 supplements to the Code of Ordinances as submitted by American Legal is hereby accepted and adopted as the official Code of Ordinances for the City of Woodburn, Indiana;
   No fewer than two (2) copies of Code of Ordinances for the City of Woodburn, Indiana shall at all times be kept and maintained in the office of the Clerk-Treasurer of the City of Woodburn and shall be available for public inspection;
   All future Supplements to the Code of Ordinances submitted by American Legal Publishing shall be adopted by later ordinances and only thereafter shall become part of and shall be inserted into the Code;
   This ordinance is declared to be necessary for the immediate preservation of the peace, health, safety and general welfare of the people of this municipality, and shall take effect at the earliest date provided by law.

   Passed and adopted by the City of Woodburn Common Council this 6th day of January, 2003.
