(A) It is declared to be in the best interest of the citizens of the city and of benefit to their public safety and welfare to regulate and restrict the parking of vehicles on certain public streets in the city during show emergencies.
(B) For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning:
SNOW EMERGENCY. A period of time prior to a forecast by the United States Weather Bureau or during and after a snow fall, during which vehicular traffic is expected to be particularly hazardous or congested due to the elements, and during which period of time the parking of such vehicles could hinder, delay, and obstruct the safe flow of traffic and the proper cleaning, clearing, and making safe of certain heavily traveled public streets of this city, which streets shall be designated snow control routes by the City Council or Board of Public Works and Safety.
(C) A snow emergency shall commence by executive order, determination, and proclamation by the Mayor of the city either before, during or after a snow fall when in his sound judgement and discretion the circumstances warrant the determination of such an emergency for the public safety of the city and its citizens. The snow emergency shall continue in effect until the Mayor of the city determines that an emergency no longer exists, and accordingly terminates the emergency.
(D) (1) It shall be unlawful for the owner, driver, or operator of any vehicle to park or stop the vehicle or permit it to be parked on to stand at any time during the period of any snow emergency on any of the routes or streets designated as a snow control route.
(2) Proper signs shall be posted on the streets designated as part of the snow control route advising the public and users of the streets that those streets have been designated as snow emergency streets or routes.
(E) In addition to any other penalty any police officer on discovering any vehicle parked or stopped in violation of this section may remove the vehicle or cause it to be removed to any city owned property or to a private garage where the vehicle shall be impounded and retained. The vehicle shall be released only on the payment to the Clerk-Treasurer or the owner of the private garage of all costs and expenses incurred for the removal of the vehicle from the street.
