(a) From and after the effective date of this chapter, no person shall undertake any fill project upon any land in the Village of Wolverine Lake without a permit issued pursuant to the terms of this chapter.
(b) No permit shall be required under this chapter for a fill project if, in the discretion of the Village Administrator and/or his or her designee, the same should be waived under the following circumstances:
(1) When said project is incidental to an operation for which a building permit has been issued by the Village.
(2) When said project is incidental to development of land subject to Act 288 of the Public Acts of 1967, as amended, and when preliminary plat approval has been obtained.
(3) When said project is incidental to or under the auspices of any State act or Village of Wolverine Lake ordinance pertaining to soil erosion or sedimentation control other than this chapter.
(4) When a permit has been issued by the Village for mineral and soil removal pursuant to other Village ordinances when said project involves any normal landscaping, driveway installation and repairs, or other minor fill project conducted in the interests of good land husbandry and not in conflict with Section 1464.07 or any other Village ordinance or State law.
(5) When said project is incidental to or under the auspices of any permit granted by the Michigan State Department of Natural Resources.
