§ 117.05 CANVASSER, PEDDLER, ITINERANT MERCHANT, TRANSIENT VENDOR PERMIT (FOR-PROFIT)—PROCEDURE.
   The following provision shall apply to all persons covered by this chapter other than those intending to solicit on behalf of not-for-profit enterprises only. Procedures governing registration for not-for-profit enterprises covered by the provisions of this chapter are in § 117.04.
   (A)   All applicants for a permit to engage in the business of canvasser, peddler, itinerant merchant, or transient vendor upon premises within the village shall complete a form of application, upon which the applicant shall truthfully state the information requested, according to the following procedure:
      (1)   The form of application for a canvasser, peddler, itinerant merchant or transient vendor permit issued under this division shall be obtainable at the office of the Village Clerk and when completed by the applicant shall contain the following information: the name, address, and telephone number of the applicant, date of birth, a physical description thereof, nature of the business, name, address and telephone number of the applicant's employer, the Illinois Sales Tax Number, and the number, kind, description, and license plate numbers of vehicles used in the applicant's business, as well as any other means of identification, a statement whether the applicant has ever been convicted of a felony of this or any state or federal government, a statement whether the applicant has been convicted of a violation of the solicitation ordinance of this or any municipality, and a statement whether the applicant has ever been arrested and for what cause. Each permit issued under this division shall be printed and shall be signed by the Village Clerk. Such permit shall bear the date (day, month and year) of its issue and the date (day, month and year) of its expiration.
      (2)   In addition to filing an application in the form contained in this division, an applicant for a permit required under this division shall verify his application and shall provide the following:
         (a)   Where selling foodstuffs, a certificate issued by the county health inspector;
         (b)   Two photographs of himself no larger than two inches by two inches;
         (c)   Permit fee: $7.50 per day or $25 per week, plus the reasonably anticipated costs of any background search required by the Chief of Police;
         (d)   Certificate of insurance or a permit bond in the sum of no less than $1,000 executed by the applicant as principal.
      (3)   Upon completion of the application, the Village Clerk shall refer the applicant to the Police Department where he will surrender the original application to the Chief of Police who shall cause such investigation of the applicant's business and moral character to be made necessary for the protection of the public good. The applicant shall be required to submit to fingerprinting by the Police Department in connection with the permit application.
      (4)   If as a result of such investigation the applicant's character or business responsibility is found to be unsatisfactory, the Chief of Police shall endorse on such application his disapproval and his reasons for the same and return the application to the Village Clerk, who shall notify the applicant that his application is disapproved and that no permit will be issued. Upon a petition of the applicant, the Village Board may affirm, modify or reverse such disapproval at its next regularly scheduled meeting, subject to the provisions of the Open Meetings Act (ILCS Ch. 5, Act 120, §§ 1 et seq.) and need to post an agenda in advance of the meeting.
      (5)   If as a result of such investigation the character and business responsibility of the applicant are found to be satisfactory, the Chief of Police shall endorse on the application his approval and return the application to the Village Clerk.
      (6)   Upon payment of the permit fee and filing of a bond or certificate as described in this division, the Village Clerk shall issue a permit to the applicant.
      (7)   The Village Clerk shall cause to be kept in his office an accurate record of every permit issued. A copy of every permit issued shall be forwarded to the Police Department.
   (B)   No permit shall be issued to any person who has been convicted of the commission of a felony under the laws of this state or any other state or laws of the United States within five years of the date of application, nor to any person who has been convicted of a violation of any of the provisions of this chapter nor to any person whose permit issued hereunder has been previously revoked as herein provided.
   (C)   No permit shall be issued or in existence for a term longer than four weeks during any calendar year, whether continuous or issued in two or more segments of less than four weeks.
