§ 110.13 LICENSE CREATION; CLASSIFICATION; FEES.
   (A)   License creation.
      (1)   The Village Board has the sole power to create licenses upon such terms and conditions as it deems fit, pursuant to law.
      (2)   A person or corporation seeking to have a license created shall submit a sworn petition on a form to be supplied by the Village Clerk.
      (3)   An applicant shall be required to submit not less than 12 copies of the following documents:
         (a)   A lease, deed, or other document demonstrating that the applicant has, or will have, the right to establish the proposed business in a properly zoned location;
         (b)   A site drawing showing the exterior of the proposed location, together with parking and all necessary site improvements to meet applicable exterior codes, such as ADA and the Illinois Accessibility Code;
         (c)   A drawing of the interior of the proposed location, at a minimum in planar view, but preferably accompanied by concept drawings showing the interior and a general idea of the layout, decoration, seating, bathrooms, kitchen (if applicable) and the like;
         (d)   For restaurants, a proposed menu showing not only representative food choices, but reasonably anticipated price points;
         (e)   An application fee of $500, which shall be non-refundable, but which shall be applied toward the initial license fees in the event a license should be created by the Village Board and the applicant awarded the license by the local Liquor Commissioner.
      (4)   Notwithstanding the foregoing, the creation of Class E special event liquor licenses is allowed by simple letter petition by the qualified applicant to the Village Board. No fee is charged for the creation of such a license, although other fees set forth in this code may apply to any such Class E license.
   (B)   Classes of licenses. Liquor licenses and fees are hereby divided into classes as follows.
      (1)   Class “A” (Tavern) license, which authorizes the retail sale of alcoholic liquor for consumption within the building on the premises specified in the license and for the retail sale of alcoholic liquor in the original package for consumption other than on the premises.
      (2)   Class “B” (Package) license, which authorizes the retail sale, but not for consumption on the premises where sold, of alcoholic liquor in the original package. This class is further divided into two subclasses, "B-1" and "B-2." "B-1" licenses are available only to retail establishments which do not sell gasoline and "B-2" licenses are available only to retail establishments which sell gasoline.
      (3)   Class “C” (Club) license, which authorizes the retail sale of alcoholic liquor by a club for consumption within the building on the premises specified in the license and for the retail sale of alcoholic liquor in the original package for consumption other than on the premises. Class “C” licenses will be issued only to fraternal groups, veterans organizations, and private clubs.
      (4)   Class “D” (Beer and Wine Restaurant) license, which authorizes the retail sale of beer and wine only within the building on the premises specified and to be consumed within the building and in conjunction with the serving of food on the premises specified only. The retail sale of beer and wine only in the original package for consumption other than on the premises is also authorized.
      (5)   Class “E” (Temporary) license, which authorizes the sale at retail at the place specified in such application for license only, alcoholic liquors for use and consumption on the premises only for the day(s) specified in the license. Class “E” licenses shall be available only to not-for-profit organizations registered with the state.
      (6)   Class “F” (Beer and Wine Package) license, which authorizes the retail sale of beer and/or wine only, but not for consumption on the premises where sold, in the original package.
      (7)   Class “G” (60/40 Restaurant) license shall authorize the retail sale on the premises specified of alcoholic liquor for consumption within the building and for the retail sale of alcoholic liquor in the original package for consumption other than on the premises. The sale of food to be consumed on the premises shall constitute not less than 40% of the business’ gross receipts. Licensees holding a Class “G” license shall be required to furnish records to the village, not less than annually, and in any event prior to the date on which renewal of said license is considered, substantiating the fact that not less than 40% of the business’ gross receipts is derived from the sale of food consumed on the premises. The Liquor Commissioner, shall have the right to audit the records submitted to ensure compliance with the sales requirements.
      (8)   A holder of a Class “A, C, D and G” license may apply for a Class “H” (Beer Garden) license to operate, outside the structure designated for such sale, upon those premises a beer garden, or area for use of umbrella or cabana type structure for serving alcoholic liquors at retail. Such license may be issued pursuant to written application in the discretion of the Local Liquor Commissioner. Class "H" licenses are strictly conditioned upon initial and continuous compliance with the regulations described in § 110.25 of this Code.
      (9)   Supplemental package sale regulations. Establishments holding Class "B-2" licenses shall be subject to the following regulation: commencing at 12:01 am on March 1, 2022, these licenses shall no longer permit the sale of spirits in any container of less than 200 ml.
   (C)   Fees. Fees applicable to each class of license are set forth in the chart below:

   (D)   A non-refundable application fee for applicants seeking a license for the first time shall be payable upon application in the amount of $250, This application fee shall be in addition to all other fees required under this section. This fee shall not be applicable to applicants seeking class E licenses.
   (E)   A request for approval for a new manager or agent under § 110.23 shall be considered upon written application and payment of an additional fee in the sum of $250.
