§ 52.045 TEMPORARY AND CONSTRUCTION DRIVEWAYS.
   No construction, site clearing or other intensive use of land shall be begun unless and until a temporary driveway permit shall have been applied for, obtained and the driveway installed. The permit process shall be the same as that described in § 52.040 of this code. A temporary or construction driveway shall be constructed by coring (for example, excavating) a roadbed to a depth of not less than six inches and a width of not less than 12 feet. The cored roadbed shall then be filled with compacted clean crushed gravel (grade 9 or equivalent). All ditches shall be protected by an appropriately-sized culvert and care shall be taken to protect sidewalks, curbs, gutters and underground pipes and utilities. The permittees shall be responsible for any damage to any public structures and/or public utilities, and shall be responsible to clean up any mud, debris or other materials deposited from the site, including any coming from the construction of the driveway on the public way or in any ditches, gutters or sewers. Any person violating this section shall be subject to the penalty provided for in § 52.999.
