509.08 CURFEW HOURS FOR MINORS.
   (a)   No parent or guardian of any child under the following ages and during the following times shall allow such child to be upon the streets or sidewalks unless accompanied by his parent, guardian or some responsible person over the age of twenty-one years or a member of his family eighteen years or older or unless such child has a legitimate excuse therefor:

Under 12   Sunset to sunrise.
12 to 16   Sunday-Thursday 10:00 p.m. to 6:00 a.m.
      Friday & Saturday 11:00 p.m. to 6:00 a.m.
16 to 18   Sunday-Thursday 11:00 p.m. to 6:00 a.m.
      Friday & Saturday 12:00 midnight to 6:00 a.m.

   (b)   Enforcement of this section shall be as follows:
      (1)   The first time a juvenile is found to be in violation of this section, an official warning will be issued;
      (2)   The second time a juvenile is found to be in violation of this section, he/she will be brought into the police station and notification will be made to the parent or legal guardian of said violation. Further, the parent or legal guardian shall be requested to come and transport the juvenile home.
      (3)   The third time a juvenile is found to be in violation of this section, and all subsequent violations, shall be considered not only a violation by the juvenile but as possible grounds for charges to be filed against the parents and or the legal guardians for violation of Ohio R.C. 2919.24, "Contributing to the Unruliness or Delinquency of a Child", a misdemeanor of the first degree under Ohio law.
 
   (c)   The Mayor is hereby authorized and empowered to suspend and alter said curfew hours when in his judgement the peace, safety and tranquility of the Municipality is endangered or when there is danger of public uprising or rioting. The Mayor is also authorized and empowered to alter said curfew hours when in his judgement, municipal and/or county events (i.e., proms, football games and other similar activity) render such an alteration reasonable. In exercising this authority, the Mayor must inform Council, properly provide public notice, and present the matter at the next scheduled Council meeting.
 
   (d)   Whoever violates this section is guilty of a minor misdemeanor.
