955.12 SANITATION FEES; COMMERCIAL NON-DUMPSTER.
   (a)   Fees charged to each commercial occupancy not requiring a dumpster shall be based upon the fee schedule established by this chapter for such occupancies, said fees to be based upon the schedule established by the Village Administrator. The fee schedule is based upon a once a week pick-up. A “bag” is defined as a thirty (30) gallon or smaller container weighing approximately thirty (30) pounds or less. An additional fee of five dollars ($5.00) per bag will be charged for every bag exceeding the amount of bags established for each generator. An additional fee of twenty-five percent (25%) of the monthly fee shall be charged to each pick-up requested in excess of one collection per week.
   The following schedule and definitions shall apply:
   (1)   Small generator:
         A.   Amount: Six (6) bags or less per week.
         B.   Rate: Eighteen dollars ($18.00) per month.
      (2)   Medium generator:
         A.   Amount: Seven (7) to twelve (12) bags per week.
         B.   Rate: Twenty-six dollars ($26.00) per month.
      (3)   Large generator:
         A.   Amount: In excess of twelve (12) bags per week.
         B.   Rate: Twenty-six dollars ($26.00) per month plus five dollars ($5.00) for each bag in excess of 12 bags at the time of the weekly pick-up. All commercial occupancies that generate in excess of twelve (12) bags per week should buy and maintain a dumpster for service to avoid the excess bag charge.
 
   (b)   Fees charged to each commercial occupancy not requiring a dumpster shall be fixed by the Village Administrator following a review of the circumstances pertaining to the collection of garbage and/or rubbish based on the volumes and fee schedule listed in this section.
 
   (c)   Any user of the Village’s sanitation service who generates 12 or more thirty-pound bags of garbage and/or rubbish shall be required to have a dumpster of the appropriate size for the garbage and/or rubbish generated by the user.
 
   (d)   The Village Administrator may notify a customer that a dumpster is required for continued service. Such notice will include a reasonable time period to allow the customer to obtain a dumpster. Failure to follow the notification will result in the Village seeking remedy through provision of Section 955.99.
