(a) Garbage Bags. Plastic garbage bags, tightly secured at the top, may be approved by the Sanitation Committee as a suitable container in any area or upon any premises so long as the breakage of the bags, or the strewing of their contents upon the ground by marauding animals or any other means does not constitute either a delay or an inconvenience in the matter of its collection by the sanitation crews. Upon notification by the sanitation crews that a condition of broken bags and/or strewn garbage did exist at the time of pick up upon any premises on three separate occasions, the Sanitation Committee shall have the authority to require the use of either metal or hard plastic garbage containers not exceeding thirty gallon capacity, equipped with suitable handles and tight fitting covers, which shall be water tight, nonabsorbent, and easily washable. All such containers shall be washed as often as necessary to prevent noxious odors and contamination.
(b) Ash Containers. Ash containers shall be made of metal and have a capacity not to exceed thirty gallons or fifty pounds in weight.
(c) Rubbish Containers. Rubbish containers shall be of a kind suitable for collection purposes and shall be of such size and weight that they can be handled by one man. Individual containers shall not exceed fifty pounds in weight.
(d) Duty to Provide and Maintain Containers. Garbage and rubbish containers shall be provided by the owner or occupant of the dwelling unit or a commercial establishment. Containers that do not conform to the provisions of this chapter or have ragged or sharp edges or any other defect liable to hamper or cause injury to the person collecting the contents thereof shall be promptly replaced upon the notice.
