For the purposes of this chapter the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context words used in the present tense include the future, words in the plural number include the singular and words in the singular number include the plural. Where used in this chapter the word "shall" shall mean required compliance.
(a) "Municipality" means the Municipality of Wintersville as defined by law.
(b) "Mayor" means the Mayor of Wintersville, Ohio.
(c) "Sanitation Committee" means the Sanitation Committee of Council.
(d) "Garbage" means all putrescible wastes including vegetable and animal offal, non- reusable food or liquid containers of any substance resulting from the handling, preparation, cooking, or consumption of food and/or liquid, or the carcasses of dead animals. "Garbage" shall not include human excreta, sewage, or other water carried wastes.
(e) "Rubbish" means any discarded matter, or any matter which is to be reduced in volume, or otherwise changed in chemical or physical properties in order to facilitate it’s discard, removal or disposal. "Rubbish" shall not include parts of motor vehicles, appliances, or furniture exceeding three feet in length or fifty pounds in weight; tires, earth, sand, brick, stone, or similar substances accumulated as a result of construction operations.
(f) "Person" means any person, firm, partner, association, corporation or organization of any kind including but not limited to residential professional, educational, mercantile, institutional, or public assembly occupancies.
(g) "Residence" or "residential" means any premises occupied as a dwelling unit.
(h) "Dwelling unit" means one or more rooms arranged for the use of one or more individuals as a single housekeeping unit with cooking, living, sanitary, and sleeping facilities.
(i) "Premises" means any land, buildings, or parts thereof.
(j) "Commercial occupancy" means any person, partner, firm, association, corporation, or organization of any kind, including but not limited to educational, professional, mercantile, recreational, institutional, and public assembly occupancies.
(k) "Licensed collector" is a "person" as defined in subsection (f) of this section who has obtained a permit from the Municipality to collect, haul, and dispose of, garbage and rubbish accumulated in the Municipality.
