941.02 SEWER SERVICE CHARGE.
   (a)   The following are hereby fixed as the fair, proportional, and reasonable rates for sewer service charges based on the metered consumption of water or as stated in subsection (d) hereof. All users discharging waste to the sewage collection system shall be billed for wastewater treatment services including governmental or institutional users such as schools, municipal utilities, or other public buildings.
 
   (b)   The funds received from the collection of the rates and charges hereinafter provided shall be deposited as received with the Fiscal Officer, who shall keep the same in a separate fund designated "Sewer Revenue Fund" established by the ordinance authorizing the issuance of said mortgage revenue bonds. The revenues deposited in said ordinance shall be used only for the purposes prescribed in said ordinance, and in the mortgage trust indenture and for no other purposes.
 
   (c)   All premises connected to the system which are also connected to the municipal water supply system through a water meter shall pay at the following rates, based on the meter reading and meter size for the privilege of using the system for disposal of sanitary sewage or industrial wastes.

   (g)   Any residential account or commercial apartment complex that has a common water meter with multiple units will be charged the equivalent minimum rate of $9.60 per thousand, with a minimum of 3,000 gallons per month for each unit regardless of whether the unit is occupied or not.
   (h)   All premises connected to the system but which are not connected to the municipal water supply system shall pay at the following rate for the privilege of using the system for disposal of sanitary sewage or industrial waste.

   (i)   Annual Review of Charges. The sewer service charge and user charges shall be reviewed annually by the Municipality in order to determine whether or not they are sufficient to defray the fixed charges, amortization costs, and annual cost of operation and maintenance of the sewerage system. If the difference between the total annual revenue derived and the total annual cost is sufficient to justify an increase or decrease in the sewer service charge or user charge, the Municipality will adjust the rates as required. The purpose of the annual review is also to maintain a proportional user charge.
   Each user is to be notified at least annually, in conjunction with a regular bill, of the rate and that portion of the sewer service charge which is attributable to more costs of wastewater treatment services.

   (j)   Late Payment Charges. Bills for sewer service that are not paid by the twentieth of the month shall be subject to fifteen percent (15%) penalty.

   (k)   The foregoing charges for sewer service shall be payable monthly and shall become effective for each property or user as soon as sewer service is made available to such property or user.
 
   (l)   The owner of private property which is serviced by the system by pipes connected with said system to convey sanitary sewage therefrom shall, as well as the lessee of the premises, be liable to the Municipality for all sanitary sewerage to said system from said premises.
 
   (m)   All sewer service furnished by the Municipality through its system to its inhabitants and other users, shall be billed and paid in accordance with the provisions of this chapter and the debt service charges of said first mortgage trust indenture securing said issue of bonds.
 
   (n)   The foregoing charges are minimum charges, not maximum charges and the Municipality reserves the right and is obligated to increase the same at any time should the revenues of the system prove insufficient to pay the operating and maintenance expenses and the debt service charges of said first mortgage revenue bonds issued to pay part of the cost of said improvements described herein.
 
   (o)   The foregoing sewer rates and charges shall not be reduced without the written consent of the original purchasers of the mortgage revenue bonds issued to pay part of the cost of constructing the system, and the trustee of the mortgage trust indenture securing said issue of the bonds.
 
   (p)   Industrial buildings will be required to install meters to measure the volume of liquid wastes being discharged to the system and the rates as established in subsection (d) hereof, will be applied. The meter and all installation charges shall be paid for by property owner. The installation shall be approved by Village Administrator.
 
   (q)   The Village Administrator may require any premises to install a meter to measure the flow going to the system in which event the rates established in subsection (d) hereof will be applied. The meter and all installation charges shall be paid for by property owner. The installation shall be approved by the Village Administrator.

   (r)   A tap-in fee of two thousand five hundred dollars ($2,500.00) shall be assessed to all premises which connect to the Municipal Sewage System.
 
   (s)   Except as provided in Section 941.021, all premises connected to the sewer system and which are also connected to the municipal water supply system through a water meter and whose owner or occupants have requested that the water to said premises be shut off by the Water Department of the Municipality for any lawful reason shall pay at the minimum ¾ inch monthly rate in effect at the time the request is made.
 
   (t)   If a connection to the public sewer is to be made at a point where no Y-Branch has been provided, the Municipality will install a Y-Branch or saddle at the expense of the property owners. The charge will be based on actual costs incurred by the Municipality.

   (u)   The account holder of any premises that sustains a water leak that results in excessive water usage may make a written request to the Village Administrator or his designee for a reduction of fifty percent (50%) of the Monthly Sewer Service Charge defined in this Section for the month or months that the leak occurred. Said request shall be timely made and an account holder may only have two (2) reductions in any twenty-four (24) month period. If the Village Administrator denies the reduction the account holder may apply in writing to Council for the reduction.

   (v)   Any residential user that has a swimming pool that holds more than three thousand (3,000) gallons of water may receive an annual reduction of fifteen dollars ($15.00) from their monthly sewer bill for any water added to the swimming pool. The residential user must notify the Utilities Department prior to the filling of the pool and the Village will read the water meter before and after the pool is filled and reduce the sewer bill by fifteen dollars ($15.00) on the subsequent bill.
