Variances or deviations may be requested by a nonconforming utility and granted upon recommendation of the Municipal Engineer and approval by Council. In a genuine emergency, and to avoid unnecessary delays, the Municipal Engineer is authorized to approve the variance application; in the absence of the Municipal Engineer, the Mayor is empowered to approve such variance application.
