(a) In the event that the engineer shall determine that the removal of residual coal from deep mine workings is necessary for construction purposes as heretofore set forth, then the person, firm or corporation desirous of engaging in such removal of residual coal shall submit to Council an application for permission to engage in the removal of residual coal and plans for construction as drawn up by a qualified architect.
(b) The application provided for in subsection (a) hereof, shall contain the name and address of the applicant, a description of the land upon which the applicant is desirous of removing residual coal, the total number of acres involved in such operation, a description of the technique to be used in the operation and, in the event that construction is not feasible, a statement as to the intended reclamation and use of the area to be affected, such statement to comply with Ohio R.C. 1513.16 and 1513.161.
(c) Upon the acceptance of the application of the person, firm or corporation desirous of removing residual coal, the report from the engineer having done the study, and the plans for construction as drawn up by the aforementioned architect by Council, then the person, firm or corporation making application shall have six months in which to complete the removal of residual coal.
(d) Upon completion of the removal of residual coal, then the person, firm or corporation concerned shall have three months in which to complete the preparation of the site for construction purposes.
(e) Upon the completion of the preparation of the site for construction purposes, then the person, firm or corporation engaged therein shall have an additional six months within which to commence construction on such prepared site.
(f) In the event the construction is not commenced upon the site wherein residual coal was removed by the person, firm or corporation concerned within six months of the completion of the preparation of the site for construction, then such person, firm or corporation is to immediately commence and continue to completion the reclamation of the land involved pursuant to the requirements as set forth in Ohio R.C. 1513.16 and 1513.161, such reclamation to be completed within one month of the commencement date.
