715.06 SUBJACENT SUPPORT TO SURFACE FOR CONSTRUCTION.

Determination of the adequacy of subjacent support to the surface for construction purposes shall be made by a qualified engineer, such engineer to be chosen by mutual agreement of the person, firm or corporation desirous of engaging in the removal of residual coal from deep mine workings and Council. The engineer shall be paid by the person, firm or corporation desirous of engaging in the removal of such residual coal in connection with site preparation and grading preparatory to construction of improvements. The engineer shall make a report of his findings in writing to Council.
