§ 152.23 APPROVAL OR DISAPPROVAL OF APPLICATION.
   (A)   If the plan conforms with the requirements of this chapter, the town shall approve the plan and issue a grading permit to the applicant with a copy of the approved plan.
   (B)   If the erosion and sediment control plan does not conform with the requirements of this chapter, the plan shall be disapproved, and written notification indicating the reason or reasons for plan disapproval shall be forwarded to the applicant by the town.
   (C)   Review of erosion and sediment control plan shall require 30 days or less from the date of submittal until the time a decision is rendered, either approving or disapproving the plan. If, at the end of the 30-day period, a decision has not been reached, the plan shall be deemed approved and a grading permit issued on demand.
   (D)   If an erosion and sediment control plan is disapproved, the applicant may elect to correct the indicated deficiencies in conformance with the provisions of this chapter and resubmit the plan to the town.
