§ 70.09 CARELESS OPERATION UNLAWFUL.
   (A)   It shall be unlawful for any person to operate any vehicle within the limits of the town without care and caution and full regard for safety of persons or property. Any person failing to do so shall be guilty of careless driving or riding. The operation of any vehicle when the same or any of its parts or appliances is not in proper or safe condition shall be prima facie evidence of careless driving or riding.
   (B)   Careless operation is unlawful and may be a lesser included offense of reckless driving. Violations of this section shall be punished by fine or imprisonment or both, in the discretion of the court, not to exceed the statutory limits of authority granted to the Municipal Court of the town.
