(A) If any customer of the town fails to comply with the mandatory water use restrictions of this subchapter, the customer shall be given a written notice of the failure to comply, which cites the date of the violation, and shall be assessed surcharges in accordance with the following schedule:
(1) First violation: a $150 surcharge shall be added to the customer’s water bill;
(2) Second violation: an additional $150 surcharge shall be added to the customer’s water bill; and
(3) Third violation: the customer’s water service shall be terminated and restored only after payment of a surcharge of $1,000 in addition to all previously assessed surcharges, and a reconnection fee of $50.
(B) Law enforcement agencies and other authorized agencies or designated employees in the respective jurisdiction which is being supplied water by the town shall diligently enforce the provisions of the drought response ordinance.
