ORDINANCE NO. MC-201-98

AN ORDINANCE RATIFYING AND CONFIRMING THE ADOPTION OF ORDINANCE NO. MC-196-97, “AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE VILLAGE OF WINNETKA BY ADDING A NEW CHAPTER 37 TO IMPOSE A MUNICIPAL TELECOMMUNICATIONS INFRASTRUCTURE MAINTENANCE FEE”

WHEREAS, the Illinois Telecommunications Municipal Infrastructure Maintenance Fee Act, Public Act 90-154 (the “Act”), has been duly enacted and became effective on January 1, 1998; and

WHEREAS, the Council of the Village of Winnetka duly passed Ordinance No. MC-196-97 on October 21, 1997, to add a new Chapter 37 to the Winnetka Village Code, which imposes a municipal telecommunications infrastructure maintenance fee pursuant to the Act and said ordinance; and

WHEREAS, Ordinance No. MC-196-97 was approved by the President of the Village of Winnetka and posted in accordance with the provisions of the Village Charter; and

WHEREAS, the Council of the Village of Winnetka desire to ratify and confirm the approval and the enactment of Ordinance No. MC-196-97.

NOW, THEREFORE, the Council of the Village of Winnetka do ordain as follows:

SECTION 1 : The corporate authorities of the Village of Winnetka do hereby ratify and confirm the adoption, approval and enactment of the Village of Winnetka Ordinance No. MC-196-97, entitled “An Ordinance Amending the Municipal Code of the Village of Winnetka by adding a new Chapter 37, to Impose a Municipal Telecommunications Infrastructure Maintenance Fee.”

SECTION 2: This Ordinance shall take effect immediately upon passage, approval and posting.

   ADOPTED this 17th day of February, 1998, pursuant to the following roll call vote:
