A. Short Title. This Chapter shall be known as the “Village of Winnetka Cable Communications and Video Service Ordinance.”
B. Purpose. The purposes of this chapter are to:
1. Provide for the granting of franchises to permit the use of Village streets and other public ways for cable communication systems; and
2. Provide for the regulation by the Village of the erection, construction, reconstruction, installation, operation, maintenance, dismantling, testing, repair and use of such systems in, upon, along, across, above, over or under or in any manner connected with the streets and other public ways within the Village, as it now or in the future may exist; and
3. Provide for the regulation by the Village of the service to be provided and of the rates and fees to be charged by persons granted such franchises; and
4. Provide far the payment of fees and other valuable consideration to the Village for the use of Village streets and other public ways by such systems and to compensate the Village for costs associated with such use; and
5. Provide for the development of cable communication systems as a means to improve communications between and among, and to otherwise serve the present and future needs of, the government, the citizens, the private and public institutions and organizations and the commercial enterprises of the Village and surrounding communities; and
6. Provide remedies and prescribe penalties for violations of this chapter and the franchise agreements executed pursuant to this ordinance.
