Section 14.04.220   Right-of-Way Usage Fee; Permit Fees.
   A.   Right-of-Way Usage Fee. Unless otherwise provided by law or by a franchise, license or other similar agreement, each utility using the rights-of-way as a location for utility facilities pursuant to a permit issued under this chapter shall be subject to the payment of the fees established pursuant to Chapter 14.12 of this Code. As used in this chapter, the right-of-way usage fee shall mean and include the service provider fee authorized pursuant to Section 21-801 of the Cable and Video Competition Law of 2007, 220 ILCS 5/21-801.
   B.   Permit Fees. Unless otherwise provided by law or by a franchise, license or other similar agreement, each utility performing any work in the rights-of-way pursuant to a permit issued under this chapter shall pay a permit processing fee equal to the sum of a base fee of $ 750.00, plus the hourly fees for services provided by Village personnel in conjunction with the review of the permit application and the issuance and administration of the permit. The hourly fees shall be established annually by the Village Council in the resolution setting general rates and fees.
   C.   Additional Fees. If any work in the right-of-way that requires review by any board or commission of the Village, the utility seeking to perform such work shall also pay the fees authorized by this Code and established by ordinance or resolution of the Village Council.
