12.24.030   Restrictions and Limitations.
   A.   Any awning that extends into a street or sidewalk of the Village shall meet all of the following requirements:
      1.   It shall be covered with cloth or other light and pliable substance.
      2.   It shall be securely attached to the building.
      3.   It shall be properly supported, without posts, by iron or other metallic fastenings and supports.
      4.   The clearance between the highest part of the pavement and the lowest part of the awning or canopy, including the frame, shall be no less than 8 feet.
      5.   It shall not project over more than three-fourths of the width of the sidewalk.
      6.   It shall not be constructed of or repaired with wood, either wholly or in part.
   B.   A rigid canopy may be permitted to extend over any public street, sidewalk or alley in the Village, provided that it meets all of the requirements of the foregoing subsection A.
   C.   Any awning that is subject to the requirements of this section, that was lawfully in existence prior to March 4, 2003, that has a clearance between the highest part of the pavement and the lowest part of the awning, including the frame, of less than 8 feet but not less than 6½ feet, and that is otherwise in compliance with the provisions of this section,, shall be deemed in compliance with the terms of this section until any portion of the support apparatus of the awning is replaced, at which time the awning must be installed and maintained no less than 8 feet at its lowest part above the highest part of the sidewalk.
