The person to whom a building a street occupation permit is issued shall make a deposit in an amount specified in the permit to insure the maintenance of the street, sidewalk and parkway in a safe and clean condition during any construction activities and to insure its complete restoration after completion of the structure or addition. Whenever any pavement, curb, parkway, sidewalk or other public structure is damaged by the erection or alteration of any structure or addition abutting on any pavement, curb, parkway, sidewalk or other public structure by reason of the construction of any structure or addition, the same shall be restored by, or at the expense of the depositor, to a condition as good and serviceable as prior to the beginning of the work. Upon such restoration as much of such deposit as shall have been expended by the Village for such restoration, street cleaning, or for any other work done by the Village and occasioned by the construction shall be retained by the Village and the remainder returned to the depositor. This shall not preclude the Village from recovering against the person for damage done to any pavement, curb, parkway, sidewalk or other public structure.
