Section 9.04.050   Tobacco and smoking instruments; Sale to minors.
   A.   It is unlawful to sell or in any manner distribute to a minor any tobacco or any manufactured article consisting in whole or in part of tobacco or designed or marketed for use in the consumption of tobacco. Any person who violates this subsection shall be subject to a fine of not less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00).
   B.   It is unlawful for any minor to possess tobacco products, including cigarettes, or to possess any products designed or marketed for use in the consumption of tobacco.
   C.   For purposes of this section, a minor is any person who has not yet reached eighteen (18) years of age. Any minor who violates this subsection shall be subject to a fine of seventy-five dollars ($75.00).
