Terms used in this chapter have the following meanings:
"Agency" means the Solid Waste Agency of Northern Cook County, a municipal joint action agency, established pursuant to an agreement dated May 2, 1988 by and between the Village and twenty-five (25) other municipalities.
"Ashes" means the residue from the burning of heating fuel or rubbish of any kind in approved incinerators or fireplaces.
"Garbage" means any rejected or discarded animal, fruit or vegetable matter which is subject to decay, putrefaction or the generation of noxious or offensive gases or odors which, during or after decay, may serve as a breeding place or as feeding material for insects or rodents, including but not limited to any rejected or discarded organic matter attending or resulting from the preparation or use of foods and the materials used for wrapping such food, but excluding used sharps and unused sharps that do not fall within the definition of household rubbish.
"Household rubbish" means debris from normal, day-to-day household operation, including but not limited to, discarded tin cans, bottles, cartons, boxes and wrapping paper. Used sharps and unused sharps may be considered household rubbish, provided they meet the following requirements:
1. The sharps must be generated in the course of routine home health care and must be disposed of at the residence of the person or persons receiving such home health care; and
2. The sharps must be disposed of by disassembling them, if possible, and sealing them in a rigid, leak-resistant, puncture-resistant container that is of a strength sufficient to prevent tearing or bursting under normal conditions of use and handling, and that is clearly marked with the words "DO NOT RECYCLE" written in capital letters in indelible ink on a water-resistant label.
"Manure" means the excrement of all fowl and domestic animals, including but not limited to dogs, and any litter or bedding materials of such animals.
"Miscellaneous rubbish" means discarded material from the operation of any business establishment or household, including but not limited to debris from building construction, repair or remodeling, and discarded material not otherwise defined in this section, but excluding used sharps and unused sharps.
"Municipal waste system" means the means by which waste collection, transportation and disposal services are provided by the municipality, including all physical assets of the municipality used for the collection, transportation and disposal of system waste, all amounts on deposit in the Municipal Waste System Fund and all amounts collected on account of rates and charges imposed under this chapter.
"Municipality" or "Village" means the Village of Winnetka.
"Open burning" means the combustion of any matter in a manner that emits the products of such combustion into the open air without the use of equipment for which a permit could be issued under Section 9(b) of the Illinois Environmental Protection Act of 1970 (415 ILCS 5/1, et seq.).
"Person" means any natural individual, firm, trust, estate, partnership, association, joint stock company, joint venture, or corporation, or a receiver, trustee, conservator or other representative appointed by order of any court.
"Project use agreement" means the 1992 project use agreement by and between the municipality and the agency, as amended from time to time.
"Recycling" means a method, technique, or process designed to remove any contaminant from waste so as to render that waste reusable, or any process bv which materials that would otherwise be disposed of or discarded are collected, separated, or processed and returned to the economic mainstream in the form of raw materials or products. Recyclable materials include plastic bottles and containers, food and beverage cans and containers, paper, cardboard and paperboard, glass bottles and containers that can be processed as recyclable materials.
"Refuse" means all system waste, as well as ashes, manure and yard waste.
"System waste" means garbage, household rubbish and miscellaneous rubbish except for debris from building construction, repair or remodeling as defined in this section discarded by persons within the corporate boundaries of the Village. System waste does not include debris from building construction, repair or remodeling, construction and demolition debris other than that which is collected as part of any special cleanup program, tires, white goods or other large accumulations of scrap metal, potentially infectious medical waste or hazardous waste other than household hazardous waste.
"Unused sharps" means instruments that may be used in animal or human patient care, medical research or clinical or pharmaceutical laboratories, but which has not been so used and has not come in contact with infectious agents, including but not limited to: hypodermic, intravenous or other medical needles, hypodermic or intravenous syringes and scalpel blades.
"Used sharps" means instruments used in animal or human patient care, medical research or clinical or pharmaceutical laboratories, including but not limited to: hypodermic, intravenous or other medical needles, hypodermic or intravenous syringes, Pasteur pipettes, scalpel blades, blood vials, and broken or unbroken glass (including slides and cover slips) in contact with infectious agents.
"White goods" means appliances, including but not limited to stoves, plumbing fixtures, water heaters and washing machines.
"Yard waste" means accumulations of discarded grass and shrub clippings, weeds, leaves, twigs, tree prunings, and other clipped, fallen, or uprooted yard and garden matter.
