A. The Village Sanitarian may, without prior warning, notice or hearing, issue a written suspension notice immediately suspending any license to operate a food service establishment or retail food store if the holder of the license does not comply with the requirements of this chapter, if a critical violation is present, or if the operation of the establishment otherwise constitutes a substantial hazard to the health of the public.
B. Whenever a license to operate a food service establishment or retail food store is suspended, the Village Sanitarian shall issue a written notice of the suspension to the licensee, or the person in charge of the premises. The notice shall specify the grounds for the suspension and shall inform the licensee that an opportunity for a hearing will be provided if a written request for a hearing is filed with the Community Development Director by the licensee within ten (10) days. If a written request is filed within ten (10) days, an opportunity for a hearing with the Community Development Director shall be afforded within twenty (20) days of receipt of the written request. If no written request for a hearing is filed within ten (10) days, the suspension is sustained.
C. Upon delivery of a notice of suspension from the Village Sanitarian or his/her designee, all food-related operations on the premises shall cease immediately. The suspension shall remain in effect until the Village Sanitarian or his/her designee determines that the grounds for suspension no longer exist, except that a suspension shall be rescinded immediately if, at the end of a hearing under this section, the Community Development Director does not sustain the suspension.
