Section 8.12.080   Issuance of New License on Change of Ownership
   A.   Prior to the change of ownership of any establishment for which a license is issued or required under this chapter, the prospective owner shall apply for a license to operate. Upon receipt of such application, the Village Sanitarian shall cause an inspection to be made of the establishment. The findings of such inspection shall be given to the prospective owner and current food establishment license holder. These findings shall include a list of requirements necessary to bring the establishment in to compliance with all applicable Village, State and Federal codes, ordinances and rules and regulations.
   B.   Prior to the issuance of a food license to the prospective owner, the prospective owner must agree in writing to comply with all deficiencies enumerated on the inspection report within a prescribed time period. When structural, plumbing, electrical, ventilation, or similar such defects exist in an established food establishment that may require a significant expenditure to correct, but are not considered to be an imminent health hazard or critical violation, a conditional license may be issued at the discretion of the Village Sanitarian. Under no circumstances will a conditional license be issued for more than two (2) consecutive six-month periods.
