A. Duty of taxicab operators.
1. It is the duty and responsibility of every person who applies for or has been issued a taxicab operator's license under the provisions of this chapter to maintain each vehicle used or proposed to be used in the applicant's or licensee's taxicab business in a safe and sanitary condition.
2. It is the duty and responsibility of every person who applies for or has been issued a taxicab operator's license under the provisions of this chapter to submit every vehicle used or proposed to be used in the applicant's or licensee's taxicab business for an inspection at least once a year and at such other times that the Chief of Police may determine is necessary to assure compliance with the provisions of this section.
3. It is the duty and responsibility of every person who applies for or has been issued a taxicab operator's license under the provisions of this chapter to keep each vehicle's safety certification in the vehicle at all times it is being operated in the taxicab business.
4. It is the duty and responsibility of every person who applies for or has been issued a taxicab operator's license under the provisions of this chapter to exhibit such vehicle safety certification whenever requested to do so by any passenger, the Chief of Police or any other law enforcement officer.
B. Taxicab inspections. Any vehicle that is used or proposed to be used in the taxicab business in the Village shall be inspected or tested periodically to determine whether such vehicle is in a safe and sanitary condition. Such inspection or testing shall include an annual safety lane inspection, provided that any vehicle that is used or proposed to be used in the taxicab business shall have passed a safety lane inspection within the 6 months preceding the date of the application
C. Authority of Chief of Police. In addition to the foregoing inspection requirements, the Chief of Police shall have the authority to require any taxicab to undergo additional inspection or testing, or to require proof of such additional inspection or testing, at least once every four months during the term of the license, or on complaint, to determine whether such taxicab is in a safe and sanitary condition.
D. No taxicab shall be operated in the Village if it is found to be in an unsafe or unsanitary condition, unless and until the operator of the vehicle has provided adequate proof, as determined by the Chief of Police, that such unsafe or unsanitary condition has been corrected.
