Section 5.66.020   Definitions and Exclusions
   A.   Special Event. As used in this chapter, "special event" means an activity on public or private property that is not sponsored in whole or in part by the Village of Winnetka and that requires the Village to provide special services.
   B.   Special Services. As used in this chapter, "special services," means the exclusive allocation of Village resources, including but not limited to Village personnel, equipment, rights-of-way or property, for use in conjunction with a specific event or activity, as requested by the host or sponsor of the event, or as requested by or on behalf of any person attending the event. Special services shall include, but not be limited to, any of the following: street closures; requiring police officers to stop or reroute traffic; special police protection; stationing emergency vehicles at or in the immediate vicinity of the event; exclusive use of Village streets as a staging area or for event parking; additional street cleaning and garbage removal services; special signage, such as temporary no parking signs; the use of any Village building, equipment or other property for any purpose other than the normal daily operations of the Village; and otherwise providing exclusive services.
   C.   Official Visit or Appearance. As used in this chapter, "official visit or appearance" means a visit or appearance of an elected official that is paid for with public funds and that is open to the general public.
   D.   Exclusions. For purposes of this chapter, the following shall not be considered special events:
      1.   An official visit or appearance of the President or Vice-President of the United States.
      2.   An official visit or appearance by the Governor of the State of Illinois
      3.   An official visit or appearance by an incumbent United States Senator elected by the voters of the State of Illinois.
      4.   An official visit or appearance by the member of the United States Congress elected by the voters of the Congressional District in which the Village of Winnetka is located.
      5.   An activity or event held, sponsored or co-sponsored by the Village of Winnetka, the Winnetka Park District, the Winnetka Public Schools, New Trier High School or Winnetka-Northfield Public Library, including but not limited to graduation ceremonies and athletic events.
      6.   An activity or event that occurs outside the corporate limits of the Village, for which Village personnel, services and/or resources are provided pursuant to a mutual aid agreement, other intergovernmental agreement, or a custom and practice of intergovernmental cooperation in which the participating municipalities do not charge the activity or event sponsor and do not charge each other for services provided.
      7.   An annual, community-wide event, such as the “Winnetka Days” sidewalk sale and the Winnetka Children’s Fair, that is sponsored by an organization that is located in the Village, that serves the residents or businesses of the Village, that is open to the general public without charge, that does not require the exclusive assignment of Village personnel or vehicles, and that requires only the use of public streets, sidewalks or open spaces subject to approval by the Village Council.
      8.   Parades, processions and funeral processions, which shall remain subject to the provisions of Chapter 10.08 of this Code.
   E.   Village Equipment. As used in this chapter, the term “Village equipment” includes any vehicle of any type that is owned, leased or used by the Village and any equipment owned, leased or used by the Village in providing firefighting, police, medical rescue, water, electric or public works services.
   F.   Village Personnel. As used in this chapter, the term “Village personnel” includes both full-time and part-time employees of the Village, employees of other municipalities who provide services to or for the Village pursuant to a mutual aid or other intergovernmental cooperation agreement, and independent contractors who provide services to or for the Village
   G.   Village Property. As used in this chapter, the term “Village property” includes any and all real or personal property owned, leased or used by the Village, and all public streets, sidewalks and rights-of-way within the Village.
