Section 5.09.255   Sealing and Removal of Partially Consumed Bottles of Wine.
   A restaurant or specialty restaurant authorized to sell and serve alcoholic beverages under a Class A or Class A-1 license may allow a customer to remove one unsealed and partially consumed bottle of wine for consumption off the premises, subject to all of the following conditions:
   A.   The patron shall have purchased a complete meal and consumed a portion of the bottle of wine with the meal on the restaurant’s premises.
   B.   The partially consumed bottle of wine shall be securely sealed by the liquor licensee or an agent of the liquor licensee and placed in a transparent, one-time use, tamper-proof bag before the patron leaves the premises. The use of tamper-evident, resealable bags is prohibited.
   C.   The licensee or agent of the licensee shall provide the patron with a dated receipt for the purchase of the wine and meal.
