Section 3.24.070   Powers and Duties; Limitations.
   A.   Powers and Duties of the Board. Subject to the limitations set forth in subsection B of this section, the Board shall have the following powers and duties:
      1.   To adopt all rules and regulations required by this chapter and such other rules and regulations necessary and appropriate to carry out the Board's statutory and ordinance powers; provided, that no such rule shall be made to govern the operation of the Department or the conduct of its members, and no such rule shall be inconsistent with chapter 3.02 of this code;
      2.   To set apart, for appropriation by the Village Council to the Board, the funds received by the Village pursuant to the levy of the foreign fire insurance company tax; and
      3.   To spend funds appropriated to the Board by the Village Council; provided, such expenditures are for the maintenance, use and benefit of the Department.
   B.   Limitations of Powers. The powers granted in subsection A of this section shall be subject to the following conditions and limitations:
      1.   The expenditures shall include the operating expenses of the Board and the purchase of the Treasurer's bond.
      2.   The expenditures may be for such items as household goods, fire apparatus, office equipment, small tools, hose, hose appliances, safety equipment, ambulance and rescue equipment, training equipment, station furniture and appliances; provided, that they are used in or directly in relation to the operations of the Fire Department.
      3.   No expenditures shall be made for any item that is not used in or is not directly related to the operations of the Fire Department.
      4.   Prior to the appropriations of funds by the Board, the Board shall develop and maintain a listing of those items that the Board feels are appropriate expenditures under applicable statutes and Village ordinances.
      5.   All expenditures of the Board shall be in accordance with the ordinances, rules, procedures and policies of the Village regarding the holding and spending of any moneys.
      6.   The funds of the Board shall be audited annually as part of the Village's annual audit. The audit shall verify that the funds have been expended by the Board only for the maintenance, use and benefit of the Department, as provided by applicable state statutes and Village ordinances.
