Section 2.56.030   Duties of Health Officer.
   A.   Enforcement of Regulations. It shall be the duty of the Health Officer to execute and enforce all statutes of the state, provisions of this code and other ordinances of the Village, and rules and regulations approved from time to time by resolution of the Council relating to health. He or she shall take such other action as is necessary for the determination of the status of and promotion and improvement of the public health, not inconsistent with the foregoing statutes, ordinances, rules and regulations. The Health Officer shall have the power to appoint and remove, and to fix the duties of other employees of the Health Department, subject to the approval of the Village Manager.
   B.   Notices of Violations and Prosecution of Violators. When it appears that any health ordinance or regulation has been violated, the Health Officer shall cause notice of such fact to be given to the person concerned, who shall be given an opportunity to be heard concerning such alleged violation. The notice shall specify the date, hour and place of hearing and the hearing shall be private. If, after such hearing, the Health Officer or other authority shall believe the ordinance or regulation has been violated, the Health Officer shall cause the alleged violators to be prosecuted.
   C.   Deputy Building Officer. The Health Officer is made a Deputy Building Officer. He or she shall aid the Director of Public Works in administering and enforcing the provisions of this code pertaining to health, sanitation and home safety.
      The Health Officer and assistants shall have the right to enter private premises for lawful inspection purposes, subject to the limitations imposed on building inspections generally under this code.
   D.   Personnel. Personnel of the Health Department are authorized to accept appointment to positions identical with those they hold in the Department in any agency with which the Village has entered into a cooperative public health agreement.
