§ 94.18 DOMESTICATED MINIATURE VIETNAMESE POT-BELLIED PIGS OR TEACUP PIGS.
   (A)   Domesticated Vietnamese miniature pot-bellied pigs or teacup pigs. Domesticated Vietnamese miniature pot-bellied pigs or teacup pigs may be kept as pets within all districts of the city by permit only as specified in this section. Said animals shall be vaccinated at least one time every three years.
   (B)   Permit required. No person shall own, keep, harbor or have custody of any live domesticated Vietnamese miniature pot-bellied or teacup pig without first obtaining a permit for such animal from the city. The city shall grant a permit for such animals to the applicant if the applicant has submitted a complete application which establishes that he or she meets all of the requirements for such a permit as set forth in this section below. No household shall be allowed to keep, harbor or have custody of more than two of said permitted animals at one time.
   (C)   Permit requirements. Any person desiring a permit for such animals under the provisions of this section shall make a written application to the City Administrator therefore upon a form prescribed by the city, including, but not limited to the following:
      (1)   An address and parcel number of the real property for the permit.
      (2)   The breed of such animal(s) for which the permit is sought.
      (3)   A written consent from 100% of the owners or occupants of the real property parcels located adjacent to the parcel for which the permit is being requested, or in the alternative, proof that the applicant's property lines are 150 feet or more from any dwelling unit.
      (4)   Proof of appropriate vaccination for the permitted animal(s).
      (5)   A statement that the applicant will at all times keep such animal(s) in accordance with any and all special permit conditions prescribed by the city or its agents/officials and that failure to obey such conditions will constitute a violation of the provisions of this section and be grounds for cancellation of the permit.
      (6)   Payment of a fee for said permit issued per this section as set by resolution of the City Council, from time to time.
      (7)   Such other and further information as may be needed by the City Administrator.
   (D)   Term. The permit period under this section shall be for one year from the date the permit is issued after approval thereof by the City Council, subject to any special conditions as set forth in the approved permit.
   (E)   Revocation. The city may revoke any permit issued under this section if the person(s) holding the permit refuse(s) or fail(s) to comply with the terms of this section, with the conditions of the permit and/or any state, federal or local law governing cruelty to animals or the keeping of animals. If such a permit is revoked, said permitted animal(s) shall be removed from the city within five days of the revocation and no part of the permit fee shall be refunded.
