For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
MOTORIZED BICYCLE. A bicycle with or without operable pedals and an internal combustion engine or battery-powered motor, which may be propelled by human power or by an internal combustion engine or battery-powered motor, or by both, and, when powered by an internal combustion engine, having a rating of no more than 1.5-brake horsepower, and a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission, and a maximum design speed of not more than 25 miles per hour on a flat surface.
OFF-ROAD VEHICLE. Any motor driven vehicle capable of cross country travel, without benefit of a road or trail, on or immediately over land, water, snow, ice, marsh, swampland, or other natural terrain. The term includes, but is not limited to, a multi-wheel drive or low pressure tire vehicle, amphibious vehicle, ground effect air cushion vehicle, mini-bike, snowmobile, or other means of transportation deriving motive power from a source other than muscle or wind. The term does not include a farm vehicle used for military or law enforcement purposes, construction, mining, or other industrial related vehicles used in performance of its common function or a registered aircraft.
OPERATE. To ride in or on, to drive, to use, to put into action, cause to function, or to be in actual physical control of a vehicle as defined herein. The term shall include any form or tense thereof.
OPERATOR. Any person who drives, operates, or is in actual physical control of a vehicle defined herein.
OWNER. A person who holds the legal title of a vehicle, or in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee; or in the event a mortgagor of a vehicle is entitled to possession, then the conditional vendee or lessee or mortgagor shall be deemed the OWNER for the purpose of this chapter.
PEDESTRIAN. Any person afoot.
SNOWMOBILE. An off-road vehicle utilizing an engine to propel it and designed for travel primarily on snow or ice of any type, utilizing sled type runners or skis, or an endless belt tread, or any combination of these or other similar means of contact with the surface upon which it is operated.
