Except when authorized or directed by state law to immediately take a person arrested for a violation of any of the traffic laws of the state or of the ordinances of the town before a law enforcement officer upon making an arrest for violation of the traffic laws of the state or the town, shall take the name, address, and operator’s license number of the alleged violator, and the registration number of the vehicle involved, and shall issue to him or her on the form prescribed in this title, a notice to answer to the charge against him or her, at a place and at a time to be specified in the notice to appear. The officer, upon receiving the written promise to appear of the alleged violator, shall release that person from custody.
